This Terms of Use Agreement (“Terms of Use”, and together with any applicable Supplemental Terms (as defined below), the “Agreement”) describes the terms and conditions that apply to your use of (i) the website located at supp.fit and its subdomains and any of supp.fit’s other websites on which a link to these Terms of Use appears (collectively, the “Website”), (ii) any mobile application(s) that we offer subject to these Terms of Use (each, an “Application”), and (iii) the products, services, content, and other resources available on or enabled via our Website or Application (collectively, with our Website or any Application, the “Services”).
Please read this Agreement carefully. This Agreement governs the use of the Services and applies to all users visiting or accessing the Services.

Such Supplemental Terms will either be set forth in the applicable supplemental Services or will be presented to you for your acceptance when you sign up to use the supplemental Services.
If these Terms of Use are inconsistent with the Supplemental Terms, then the Supplemental Terms control with respect to such supplemental Services.

supp.fit does not control such third-party materials and makes no representations or warranties regarding their continued availability, accuracy, completeness, legality, or reliability.
All rights in third-party Research Materials remain with their respective owners.
You should not rely on AI Features or Research Summaries as the sole basis for any decision regarding your health, supplementation, medication, diagnosis, treatment, or use of any product.
You are solely responsible for how you use and interpret AI-generated information.
supp.fit makes no representations or warranties regarding the accuracy, reliability, completeness, scientific validity, or appropriateness of any information generated by the AI Features, and your use of such information is at your own risk.

If you are represented by counsel, the Notice should also include counsel’s contact information.
The parties agree to engage in good-faith informal communications and, if reasonably requested by either party, a telephone or video conference to attempt to resolve the Dispute.
Unless the parties agree otherwise, arbitration may not be commenced until at least thirty (30) days after the Notice of Dispute is received.
Applicable limitation periods and filing deadlines shall be tolled during this required informal dispute resolution period to the extent permitted by applicable law.
15.3. Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND supp.fit WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO HAVE A DISPUTE COVERED BY THIS ARBITRATION AGREEMENT DECIDED IN COURT BY A JUDGE OR JURY.
Arbitration uses a neutral arbitrator instead of a judge or jury, and court review of an arbitration award is limited.
15.4. Waiver of Class and Other Non-Individualized Relief
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND supp.fit AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF, CLAIMANT OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE OR MASS ACTION.
EXCEPT AS PROVIDED BY THE AAA MASS ARBITRATION SUPPLEMENTARY RULES OR AS OTHERWISE AGREED BY THE PARTIES, AN ARBITRATOR MAY NOT CONSOLIDATE THE CLAIMS OF MORE THAN ONE PERSON OR OTHERWISE PRESIDE OVER A CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING.
The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim, except where applicable law requires otherwise.
Nothing in this Section prevents either party from participating in a class-wide settlement.
If a final court decision determines that this waiver is unenforceable with respect to a particular form of relief or particular claim, that form of relief or claim may be severed and proceed in a court of competent jurisdiction while the remainder of the Dispute remains subject to arbitration to the extent permitted by law.
15.5. Arbitration Rules and Administrator
Arbitration will be administered by the American Arbitration Association (“AAA”) pursuant to the AAA Consumer Arbitration Rules and Mediation Procedures in effect when the arbitration is filed (“AAA Consumer Rules”), as modified by this Agreement.
Information regarding the AAA Consumer Rules and applicable filing procedures is available from the AAA at:
https://www.adr.org/rules-forms-and-fees/consumer/
This Agreement evidences a transaction involving interstate commerce. To the extent applicable, the Federal Arbitration Act, 9 U.S.C. § 1 et seq., will govern the interpretation and enforcement of this Arbitration Agreement.
A party commencing arbitration must submit the materials required by the AAA Consumer Rules and provide the other party with the arbitration demand in the manner required by those Rules.
A copy of any arbitration demand directed to supp.fit may also be sent to:
If the AAA is unavailable or declines to administer a particular arbitration and the parties cannot agree on an alternative administrator, a court of competent jurisdiction may appoint an arbitration administrator or arbitrator consistent with applicable law.
15.6. Location and Manner of Arbitration
The location and manner of arbitration will be determined in accordance with the AAA Consumer Rules and applicable law.
Where permitted under the applicable rules, a party may request that proceedings be conducted by telephone, video conference, documents-only procedure, or another appropriate method rather than through an in-person hearing.
15.7. Authority of Arbitrator
Subject to applicable law and this Agreement, the arbitrator shall have authority to resolve Disputes concerning the interpretation, application, enforceability, scope or validity of this Arbitration Agreement.
However, a court of competent jurisdiction, rather than the arbitrator, shall determine any dispute concerning the enforceability or validity of Section 15.4 (Waiver of Class and Other Non-Individualized Relief), unless applicable law requires otherwise.
The arbitrator may award relief available under applicable law and consistent with this Agreement.
The arbitrator shall issue an award in accordance with the AAA Consumer Rules.
The arbitration award will be final and binding to the extent provided by applicable law, and judgment on the award may be entered in a court with jurisdiction.
15.8. Arbitration Fees and Costs
Arbitration fees and costs shall be allocated in accordance with the AAA Consumer Rules and applicable AAA fee schedules.
supp.fit will pay arbitration fees that applicable AAA rules or applicable law require the business to pay.
Nothing in this Agreement requires a consumer to pay arbitration costs in excess of amounts permitted by applicable AAA consumer rules or applicable law.
The arbitrator may award attorneys’ fees and costs where authorized by applicable law or the applicable AAA rules.
15.9. Mass Arbitration
If the AAA determines that a group of arbitration demands constitutes a mass arbitration under its applicable rules, the AAA Mass Arbitration Supplementary Rules and applicable mass arbitration fee schedule shall govern administration of those demands in addition to the AAA Consumer Rules.
Information about the AAA Mass Arbitration Supplementary Rules is available at:
https://www.adr.org/rules-forms-and-fees/mass-arbitration/
Each claimant’s substantive claim remains an individual claim except to the extent that the applicable AAA rules provide procedures for coordinated administration, process arbitrators, mediation, scheduling, fee administration, or other efficient case-management procedures.
Nothing in this Section authorizes class arbitration.
15.10. 30-Day Right to Opt Out
You have the right to opt out of this Arbitration Agreement.

An opt-out applies only to the Arbitration Agreement.
All other provisions of this Agreement will continue to apply to you.
Opting out of this Arbitration Agreement does not affect any separate arbitration agreement that may otherwise apply between you and supp.fit.
15.11. Severability of Arbitration Agreement
Except as provided in Section 15.4, if any part of this Arbitration Agreement is determined to be invalid or unenforceable, that part shall be severed to the minimum extent necessary and the remainder of this Arbitration Agreement shall continue in effect to the fullest extent permitted by applicable law.
If applicable law does not permit arbitration of a particular Dispute, that Dispute may proceed in a court having jurisdiction, without affecting arbitration of other Disputes to the extent permitted by law.
15.12. Changes to the Arbitration Agreement
If supp.fit makes a material change to this Arbitration Agreement, we will provide notice as required by applicable law.
If you were already subject to an Arbitration Agreement with supp.fit before the change, you may reject the material change by emailing:
within thirty (30) days after the change becomes effective.
Your email must state that you reject the change to the Arbitration Agreement and include the email address associated with your Account, if applicable.
Rejecting a change does not revoke or alter a valid prior agreement to arbitrate. Instead, the version of the Arbitration Agreement that applied immediately before the rejected change will continue to govern to the extent permitted by applicable law.

16.5. Governing Law and Venue
To the fullest extent permitted by applicable law, this Agreement and any action related thereto will be governed and interpreted by the laws of the State of New York, without giving effect to conflict-of-law principles that require application of another jurisdiction’s laws.
To the extent the parties are permitted under this Agreement to initiate litigation in court and applicable law permits selection of forum, the parties agree to the state or federal courts located in New York, New York.
Nothing in this Section deprives you of mandatory consumer protections, governing-law rights, or forum rights that cannot lawfully be waived under the laws applicable to you.
16.6. EEA and UK Consumers
If you are located in the European Economic Area (“EEA”) or the United Kingdom, you may have mandatory rights under applicable consumer protection laws.
Nothing in this Agreement is intended to exclude, restrict, or limit any rights or remedies that cannot lawfully be excluded, restricted, or limited under applicable law.
If any provision of this Agreement conflicts with mandatory consumer protection laws applicable to you, those mandatory laws will apply to the extent of the conflict.
Nothing in this Agreement, including Section 15 (Arbitration Agreement), prevents you from exercising any right to bring a claim before a court, tribunal, regulatory authority, or other dispute resolution body where such right cannot lawfully be waived.
16.7. Waiver and Severability
A waiver or failure to enforce a provision of this Agreement on one occasion will not be deemed a waiver of another provision or of that provision on another occasion.

To the fullest extent permitted by applicable law, any cause of action you may have with respect to your use of the Services must be commenced within one (1) year after the claim or cause of action arises.
